These Terms of Service ("Terms") govern your access to and use of the Alien Data-Streaming Infrastructure and related services (collectively, the "Services"), operated by Alien Intelligence SAS ("Alien," "we," "us," or "our").
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
Please note that the Alien Data-Streaming Infrastructure is currently available in a limited-access Beta phase. The Services and underlying systems are still being refined and may change over time. We greatly value your feedback and encourage you to share any comments or questions at: contact@alien.club.
Alien Data-Streaming Infrastructure is designed to serve as an intermediary between Content Owners and AI Service Provider.
Its purpose is to provide a controlled and secure environment in which:
The Alien Data-Streaming Infrastructure establishes a legal, transparent, and auditable framework for leveraging licensed data in generative AI systems, while ensuring that Content Owners retain full rights and control over their Content.
Alien Intelligence SAS or Alien refers to the company providing the Services. Alien Intelligence SAS may also be referred to as "we" or "us". Alien Intelligence SAS is a French simplified joint-stock company (SAS) with a registered office at 78 rue de Provence, 75009 Paris, France, registered at Paris RCS under number 92055067000037.
Alien Data-Streaming Infrastructure or the Services refers to the proprietary infrastructure developed and operated by Alien Intelligence SAS that enables AI systems and services to interact via API and receive Generated Output derived from specific datasets that remain undisclosed by us.
The Services are designed to (i) allow real-time control over Content uploaded by Content Owners and its transformation into streamable assets, (ii) enable API-based access to Generated Output for AI Service Provider, (iii) ensure end-to-end tracking, observability and accountability of all data interactions; and (iv) support licensing and compliance with applicable intellectual property and data protection regulations.
AI Service Provider means businesses, organizations, or individuals that access and use the Services and their Generated Output through API or interface integrations, for use within their own applications, products or services, whether commercial or non-commercial.
Content means any data, information, text, documents, media file, or other form of intellectual property provided by a Content Owner for inclusion within the Services. Access to and use of Content within the Services are governed by the applicable License Agreement between Alien and each Content Owner. Content may also include datasets made available under recognized open source or open data licenses. Raw Content is never disclosed or shared with third parties.
Content Attribution means the process of associating a particular Generated Output with its corresponding source(s) of Content, including the identification of relevant Content Owners.
Content Owner means any individual or legal entity that provides Content to the Services and retains all intellectual property rights and ownership over such Content.
Content Streaming refers to the real-time generation and delivery of Generated Output in response to a specific API query or request, typically under a pay-per-query or usage-based pricing model.
Generated Output means any AI-generated content, data, or information produced by the Services in response to API queries, derived from the underlying Content, but without exposing or transferring that Content.
RAG System (Retrieval-Augmented Generation System) means a generative AI architecture that retrieves relevant elements of Content as contextual input to enhance the quality, accuracy, and relevance of Generated Output.
Service Users means all individuals or entities who interact with the Services in order to generate or retrieve Results generated via the AI Service Provider, or to provide Content for Content Owners.
Confidential Information includes all sensitive, proprietary, or non-public information exchanged between the parties under an expectation of confidentiality, including but not limited to business, financial, technical, operational, or legal information. All Confidential Information shared under these Terms is subject to NDA-level obligations of confidentiality, non-use, and limited access. In particular:
To access and use the Alien Data-Streaming Infrastructure, you must create an account and register as one of the following:
You maintained accurate and up-to-date information associated with your account, as well as for the accuracy and legality of any Content you upload or process.
You must also keep your account credentials secure and confidential, and you remain fully responsible for all activities conducted under your account.
By uploading or providing Content to the Services, Content Owner agrees to the following:
The full terms governing these uses are set forth in a separate Alien License Agreement, which defines the scope of processing for providing the Services and output sub-licensing. By continuing to use the Services, you agree to the terms of that License Agreement.
You agree to upload, transmit, or otherwise make available through the Services only Content for which you hold all necessary rights, licenses, and authorizations to use within the scope of these Terms.
Your Content must not:
By using the Services, you represent and warrant that all Content you provide complies with these requirements.
Alien Intelligence SAS reserves the right to remove or restrict access to any Content, or to suspend or terminate your use of the Services, in the event of a suspected or confirmed violation of this section, without prejudice to any other rights or remedies available to us under law or contract.
During this Beta phase, we are actively tailoring the product and licensing framework with our selected Users.
Until a generic user-facing permissions interface is deployed, we operate on a case-by-case basis. This means You may withdraw or modify your authorization at any time, subject to reasonable operational constraints.
Also, please note that currently, the 'Data licensing' option which allows an AI Service Provider to acquire data to train its model (and therefore NOT data-stream) is available on an opt-in basis in our interface, if you select 'Allow training' for your Content Dataset, please refer to the License Agreement.
If you wish to ask for a custom license setup, or restrict certain uses of your Content, please contact us directly at contact@alien.club or select "custom license" in our Services interface. Our goal is to give you maximum control over how your data is used.
The Alien Data-Streaming Infrastructure may be accessed via API or other authorized interfaces.
API documentation is available at https://datastreaming.ai and may be updated or supplemented from time to time.
AI Service Providers are responsible for reviewing and implementing the latest version of the API documentation to ensure continued compatibility and compliance with these Terms.
AI Service Providers agree to:
Alien Intelligence reserves the right to monitor API usage and take appropriate measures - including suspension or termination of access - in the event of a breach, misuse, or suspected malicious activity.
Unless expressly authorized through the opt-in Data Licensing clause, AI Service Providers and their underlying models do not have access to raw data or Content used within the Alien Data-Streaming Infrastructure.
Generated Output provided via API represents derivative AI-generated material and does not grant any right, title, or interest in the underlying Content.
Any use of Content or Generated Output for model training, fine-tuning, or dataset enrichment is strictly prohibited unless explicitly permitted under a valid opt-in license and in compliance with the Alien License Agreement.
AI Service Providers must implement and maintain appropriate technical and organizational measures to protect any API keys, credentials, or access tokens used to interact with the Services.
They remain fully responsible for all activity conducted under their account or API credentials, including any use by authorized personnel, subcontractors, or third-party integrations.
Alien may analyse aggregated usage and metadata (e.g., most queried datasets, frequency, success rate) to improve the Services and inform Content Owners on how to improve their Content. No personal or identifying information is shared without consent. This helps Content Owners optimize their datasets and licensing potential.
Any feedback, suggestions, or improvements ideas provided by the Content Owner or the AI Service Provider regarding Alien Data-Streaming Infrastructure shall be deemed non-confidential and non-proprietary.
Alien shall be free to use, reproduce, modify, or implement such feedback without restriction and without any obligation of attribution or compensation to the other party.
The pricing conditions for access to and use of the services are defined in a separate quote.
At this stage, all payments and related financial transactions are processed directly by Alien Intelligence SAS through trusted third-party payment providers such as Stripe, as detailed in the Documentation and the Privacy Policy.

Alien Data-Streaming Infrastructure is currently offered in a limited-access beta mode to selected partners.
THE SERVICES, INCLUDING THE ALIEN DATA-STREAMING INFRASTRUCTURE, CONTENT, RAG SYSTEM, API AND API DOCUMENTATION, AND ALL GENERATED OUTPUT, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
Alien Intelligence SAS makes no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, error-free operation.
Alien does not warrant that the Services or Generated Output will meet your specific requirements, operate without interruption or error, or produce results that are complete, accurate, or suitable for any particular purpose.
Generated Output is provided for informational purposes only, and you remain solely responsible for evaluating its accuracy, reliability, and legal or commercial suitability before using or relying upon it.
Generated Output may be produced using third-party AI models selected and operated by the AI Service Provider. Alien does not control or validate the behaviour of such models and makes no guarantee regarding the accuracy, appropriateness, fitness, or legality of the Generated Output that results. You acknowledge that such outputs may occasionally be inaccurate, incomplete, or inappropriate.
During the Beta phase, you acknowledge that the Services are under active development and may contain defects, errors, or interruptions. Your use of the Services during this period is at your own risk.
To the maximum extent permitted by applicable law, Alien Intelligence SAS, its affiliates, officers, employees, licensors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities, arising out of or in connection with:
(a) your access to or use of (or inability to access or use) the Services or Generated Output;
(b) any Content submitted to the Services or the results produced therefrom;
In all cases, Alien's total aggregate liability under these Terms shall not exceed the greater of €10,000 or the total amount of fees paid by You to Alien, if any, for use of the Services during the six (6) months preceding the event giving rise to the claim.
You acknowledge that the limitations and disclaimers set forth in this section are an essential basis of the bargain between you and Alien. The Services could not be provided without these limitations.
AI Service Provider or Content Owner may terminate these Terms, and any associated License Agreement, at any time by providing written notice to Alien. The effective termination will take place in the month following the termination request. All sums previously paid will be retained by Alien, which will not issue any refunds or credits.
Alien Intelligence SAS may suspend or terminate your access to all or part of the Services, without notice, if:
In urgent cases involving potential harm or data compromise, Alien may suspend access immediately, while investigating the issue in good faith.
Upon termination:
The following provisions shall survive termination: Liability and Disclaimer, Governing Law, and any other clauses that, by their nature, are intended to survive termination.
Alien is authorized to use the corporate name of the Content Owner for the purposes of Content Attribution within the Services. Content Owners are encouraged to carefully configure their company and attribution information in the Services to ensure accuracy and compliance with their own policies.
Alien is further authorized to reproduce and display the corporate name, trademarks, and logos of both Content Owners and AI Service Providers for the limited purposes of external communication, promotion, or marketing of the Services - including on Alien's website, in social media communications, in press materials, or in other informational content directly related to the Services.
Alien will use commercially reasonable efforts to comply with any applicable trademark guidelines communicated in writing by the relevant party and will promptly cease any specific use upon reasonable written request.
Alien treats all data processed through the Services - including Personal Data, Content, and Confidential Information - with the same level of technical and organizational security as personal data, in accordance with industry standards and applicable law.

Upon written request, Alien can provide Clients with documentation describing its security measures and data-handling procedures relating to Content processing.
Within the limits authorized by law, any dispute (contractual or non-contractual) concerning those Terms of Service, or its subject matter or formation (a "Dispute") is/are governed by French law (excluding its conflict-of-law's provisions). These Terms are drafted in English, which shall prevail in case of discrepancy with any translation.
IN THE EVENT OF ANY DISPUTE ARISING BETWEEN THE PARTIES CONCERNING THE VALIDITY, PERFORMANCE OR INTERPRETATION OF THE TERMS OF SERVICE, THE PARTIES AGREE TO COOPERATE DILIGENTLY AND IN GOOD FAITH IN ORDER TO FIND AN AMICABLE SOLUTION. IF, HOWEVER, NO AMICABLE AGREEMENT IS FOUND WITHIN ONE (1) MONTH AS FROM THE RECEPTION OF A LETTER NOTIFYING THE OTHER PARTY OF THE EXISTENCE OF THE DISPUTE, AND WITHIN THE LIMITS AUTHORISED BY LAW, THE PARTIES ATTRIBUTE, THE EXCLUSIVE JURISDICTION OF THE COMPETENT COURTS OF PARIS, NOTWITHSTANDING SEVERAL DEFENDANTS OR CALL OF GUARANTEE.
ALIEN reserves the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect via a messaging on our interface. If a modification is required by applicable law, it will come into effect immediately.
Notices. Under the Terms of Service, notices to You must be sent to your Account notification email address, and notices to ALIEN must be sent to contact@alien.club. Notice will be treated as received when the email is sent. By derogation, Legal Notices to us must be sent by registered letter with acknowledgement of receipt, for ALIEN, Legal department, 78 rue de Provence, 75009 Paris. You are responsible for keeping its notification email address current throughout the Term of Service.
Emails. The parties may use emails to satisfy written approval and consent requirements under the Terms of Service.
Headers. Headings and captions used in the Terms of Service are for reference purposes only and will not have any effect on the interpretation of the Terms of Service.
Assignment. We are free to assign these Terms of Service, in whole or in part, to any company in its group within the meaning of article L. 233-1 of the French Commercial Code. The transfer of these Terms of Service by us may also take place in the context of any reorganization leading to a universal transfer of assets (merger, transfer, partial contribution of assets or partial transfer of assets).
Force Majeure. Neither party will be liable for failure or delay in performance of its obligations to the extent caused by circumstances beyond its reasonable control or by any force majeure event as defined under applicable law.
Subcontracting. We may subcontract our obligations under the Terms of Service but will remain liable to You for any subcontracted obligations.
No Implied Acceptance. Except if and to the extent expressly stated otherwise in the Terms of Service, silence on the part of ALIEN is not deemed to constitute acceptance of any other contract term, contract renewal, statement, representation or warranty.
Severability. If any part of the Terms of Service is invalid, illegal, or unenforceable, the rest of the Terms of Service will remain in effect.
Independent Development. Nothing in the Terms of Service will be construed to limit or restrict either party from independently developing, providing, or acquiring any materials, services, products, programs, or technology that are similar to the subject of the Terms of Service, provided that the party does not breach its obligations under the Terms of Service in doing so.
Entire Terms of Service. The Terms of Service states all terms agreed between the parties, and supersedes any prior agreements between the parties, relating to the purpose of the Terms of Service. Neither party has relied on any written or oral statement except those expressly described in the Terms of Service.
